Agreement for Payment
I understand that registration for afterschool is done online through my In-Phase Kids Program account and the deadline to register for each week is the Sunday prior to the week(s) of desired attendance. Registration reserves your weekly spot on our roster for the entirety of the school year and weeks cannot be skipped. Registrations will not be accepted after the Sunday deadline and the start date will be the upcoming Monday.
I understand the monthly fee is based on my registration and enrollment commitment regardless of attendance, and the In-Phase Kids Program will not pro-rate regardless of absences or lapses in attendance.
I understand I must pay by the monthly draft, and I will be charged on the due dates listed on the payment schedule. The draft occurs at the beginning of each month. It is my responsibility to notify the In-Phase Kids Program of any changes to my situation or tuition plan.
If my payment is returned due to insufficient funds, I am responsible for all fees incurred and will owe a return fee of $25.00 per item to the In-Phase Kids Program. I understand that if I exit the program that my last draft will include all past due and remaining balances.
I understand if I register after the draft date, the monthly payment will be due at the time of registration.
I agree to give a two-week written notice to the In-Phase Kids Program if I plan to exit the program. I will complete a cancellation form at this time. If I fail to give a two-week written notice or contact the Business Services Department to discuss emergency withdrawals, I am responsible for any payments up to the time of notification to withdraw.
I understand if I cancel the In-Phase Kids Program Afterschool Program and my account has a past due balance, the balance will be owed at the time of cancellation.
I understand the In-Phase Kids Program will continue to draft outstanding balances until the past due amount is paid in full. If payment is not collected, my account will be sent to Collections.
I agree to pay the selected amount according to the card issuer. I further understand the card I use at checkout will be the card used for the weekly payment drafts.
Liability Consent
I, the parent, hereby acknowledge that my child will be participating in athletic training with In-Phase Training. I am fully aware of the risks involved with athletic training and understand that there is a possibility of injury or harm to my child during the course of their participation.
I understand that In-Phase Training has taken reasonable steps to ensure that the training environment is safe and suitable for athletic training. However, I acknowledge that accidents and injuries can still occur despite these precautions. I hereby assume full responsibility for any and all risks of injury or harm that may occur during my child's participation in training with In-Phase Training.
Furthermore, I hereby release In-Phase Training, its owners, employees, agents, and representatives from any and all claims, demands, damages, or causes of action arising out of or related to any injury or harm that my child may suffer while participating in athletic training with In-Phase Training. This release includes but is not limited to, any claims for negligence, breach of contract, or any other legal theory.
I agree to indemnify and hold harmless In-Phase Training, its owners, employees, agents, and representatives from any and all claims, demands, damages, or causes of action brought against them by my child, me, or any third party arising out of or related to my child's participation in athletic training with In-Phase Training.
I understand that this release and indemnity will remain in effect until the completion of my child's participation in athletic training with In-Phase Training.

Picture and Video Consent
I, the parent, hereby grant In-Phase Training, its owners, employees, agents, and representatives, the right to take photographs and videos of my child during their participation in athletic training with In-Phase Training.
I understand that the photographs and videos taken may be used for promotional and educational purposes, including but not limited to, advertising materials, social media, websites, and other marketing initiatives related to In-Phase Training.
I hereby consent to the use of such photographs and videos, without compensation to me or my child, and I waive any right to inspect or approve the final product in which the photographs or videos may be used.
I understand that In-Phase Training will make every effort to ensure that the photographs and videos taken are used in a professional manner and will not be used in any way that may be deemed inappropriate or offensive. However, I release In-Phase Training, its owners, employees, agents, and representatives from any and all claims, demands, damages, or causes of action arising out of or related to the use of the photographs and videos taken during my child's participation in athletic training with In-Phase Training.
I acknowledge that this consent and release will remain in effect until the completion of my child's participation in athletic training with In-Phase Training.

Program Authorizations
I give permission for my child to participate in water activities during hours of operation at predetermined scheduled lesson plans.
I grant permission for my child to view Director approved G-rated movies, though it is not part of regularly scheduled lesson plans.
I certify that my child’s current immunization records and TB test (if applicable) can be located at the school my child is currently attending.
I understand that it is my responsibility to notify the In-Phase Kids Program by 1 PM CST if my child(ren) will not be attending the program that day. I understand I must call or text the designated In-Phase Kids Program Site Phone.
I understand that I may be charged an additional $1.00 per minute/per child I am late after close of site.
I further understand the In-Phase Kids Program reserves the right to cancel a registration with excessive tardiness of pick-up. In the event of excessive tardiness authorities may be notified.
I understand that the In-Phase Kids Program will be closed on select holidays and care may be available at an additional cost. To ensure consistent, quality programming and staffing, Afterschool weekly fees are not credited or prorated for holidays, school closures, or inclement weather days.
Decisions regarding who is authorized to pick up a child(ren) will be governed by the Primary Parent/Guardian information listed for their registration. No person under the age of 18 may pick up a child without a signed affidavit on file. The minor must be 14-17 years of age to pick up with the signed affidavit.

The In-Phase Kids Program will be the premier sports development agency in north Texas to teach values to kids and sports skills to youth.
In-Phase Kids Program CODE OF CONDUCT AND BEHAVIOR STANDARDS
The In-Phase Kids Program is committed to providing a safe, comfortable, and welcoming environment for all and we ask all persons to act maturely, behave responsibly, and to respect the rights and dignity of others at all times when in our facilities, on our property or participating in our programs or events.
The Code of Conduct outlines prohibited actions. This list is not all-inclusive, and the In-Phase Kids Program reserves the right to deny, suspend or revoke membership / access privileges to any person if, in the In-Phase Kids Program’s sole discretion, the actions / inactions of a person are detrimental to the health, safety, or enjoyment of its employees, volunteers, members, or participants.
Unlawful, abusive, derogatory, harassing, unwelcome, obscene or violent language or behavior towards others or themselves.
Actions based on an individual’s sex, race, ethnicity, age, religion, disability, sexual orientation or any other legally protected status.
Openly carrying or concealing of any weapons, devices or objects which may be used as a weapon at a In-Phase Kids Program location or at a In-Phase Kids Program sponsored event or activity. All In-Phase Kids Program facilities have §30.06 and §30.07, Texas Penal Code signage posted.
Smoking, the use of tobacco, or the use of products intended to mimic smoking or tobacco products while in, on, or around In-Phase Kids Program property, program or events.
Using or possessing alcohol or illegal chemicals on In-Phase Kids Program property, in In-Phase Kids Program vehicles, or at In-Phase Kids Program-sponsored programs / events.
Theft or behavior that results in the destruction or loss of property.
Sexually explicit conversation or behavior.
Unsafe, inappropriate, immodest, or sexually revealing attire.
Use of cell phones in locker room or bathrooms.
Loitering within or on the grounds.
Personal fitness instruction (paid / unpaid) by anyone not certified and employed by the In-Phase Kids Program.
Accessing or permitting access to the In-Phase Kids Program facility not in compliance with In-Phase Kids Program security policies. This includes card, sharing, presenting false identification, sneaking friends into the facility, failure to provide a photo ID and photo for access, etc.
Using equipment for other than its intended purposes or not following safety instructions. Equipment orientations are available at no cost to all members and guests upon request.
The In-Phase Kids Program conducts regular sex offender screenings on all members, participants and guests. If a sex offender match occurs, the In-Phase Kids Program reserves the right to cancel membership, end program participation and remove visitation access. In addition, the In-Phase Kids Program reserves the right to deny access or membership to any person who has been arrested for or convicted of any crime involving weapons, violence, sexual abuse, or the sale, possession and / or transportation of illegal drugs.
Please notify a In-Phase Kids Program staff person immediately if there is an accident, injury, unusual incident or you believe that this Code of Conduct is being violated.
Suspension or termination of In-Phase Kids Program membership may result from a violation of this Code of Conduct. While an incident is being investigated, the membership of the person(s) accused of violating this Code of Conduct may be temporarily suspended pending a final decision.
In-Phase Kids Program POLICIES
I acknowledge and agree that I and my minor child(ren) will abide by all posted and communicated In-Phase Kids Program rules and policies.
MEDICAL TREATMENT AND TRANSPORTATION AUTHORIZATION
In the event of any emergency requiring medical care, the Y is hereby authorized to use it best efforts to obtain whatever medical treatment it deems necessary or appropriate under the circumstances. I understand accident insurance is not included in In-Phase Kids Program fees. Should I or my child(ren) require medical treatment, medication, or hospital care; I shall solely bear the expenses. I grant permission for myself and my child(ren) to be transported in an authorized In-Phase Kids Program vehicle if applicable to the specific program / event in which I / my child is registered or in the event of an emergency.
HIGH RISK ACTIVITIES ASSUMPTION OF RISKS
I hereby acknowledge and agree that participation in In-Phase Kids Program activities comes with inherent risks. I have full knowledge and understanding of the inherent risks associated with In-Phase Kids Program participation, including but in no way limited to: (1) slips, trips, and falls, (2) aquatic injuries, (3) athletic injuries, and (4) illness, including exposure to and infection with viruses or bacteria (5) injury or in extreme cases permanent trauma, or death. I further acknowledge that the preceding list is not inclusive of all possible risks associated with In-Phase Kids Program participation and that said list in no way limits the operation of this Agreement. To the best of my knowledge, I and my child(ren) have the maturity, required skills, and physical ability to participate in In-Phase Kids Program activities for which I have registered.
I HEREBY PERSONALLY, AND TO THE MAXIMUM EXTENT ALLOWED BY LAW ON BEHALF OF ALL FAMILY MEMBERS, ASSUME ALL RISK, WHETHER FORESEEN OR UNFORESEEN, IN CONNECTION WITH PARTICIPATING IN THE ABOVE ACTIVITIES, FOR ANY HARM INJURY OR DAMAGE THAT MAY BEFALL ME AS A RESULT OF MY PARTICIPATION IN SAID ACTIVITIES AT ANY TIME. IT IS MY INTENTION BY THIS INSTRUMENT TO EXEMPT AND RELEASE THE Y FROM ALL LIABILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE.
WARNING: UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.
Parent’s Rights
Senate Bill 1098 from the 88th Legislative Regular Session added Section 42.04271 to the Human
Resources Code and states that a parent or guardian of a child at a child care facility has the right to:
• Enter and examine the child-care facility during its hours of operation and without advance
notice;
• File a complaint against the child care facility;
• Review the child care facility’s publicly accessible records;
• Review the child-care facility’s written records concerning the parent’s or guardian’s
child;
• Receive inspection reports and information about how to access the child care facility’s online
compliance history;
• Have the facility comply with a court order that prevents another parent or guardian from
visiting or removing the child;
• Be given the contact information for the child care facility’s local Child Care Regulation office;
• Inspect any video recordings of an alleged incident of abuse or neglect involving their child
provided that:
• Video recordings of the alleged incident are available;
• The parent or guardian does not retain any part of the video depicting a child that
is not their own; and
• The parent or guardian of any other child in the video receives prior notice from
the facility;
• Obtain a copy of the facility’s policies and procedures handbook;
• Review the facility’s staff training records and any in-house training curriculum; and
• Exercise these rights without receiving retaliatory action by the facility.
Required Notifications
• The child care facility must provide written notice to the parent or guardian of any other child
captured in a video before allowing a parent to inspect a recording.
• The child care facility must provide a parent or guardian with a written copy of the rights no later
than the child’s first day at the facility.
Helpful Tips
Since a parent may perceive an action taken by a child care facility as retaliatory, keep in mind:
• Documentation is essential in supporting your actions; and
• Follow the suspension and expulsion policy outlined in your operational policies and update your
policy, if needed.
Sick Child Policy
Please keep students home from In-Phase Kids care if:
Temperature of 100.4 or greater. Students will need to be free of a fever for at least 24 hours before returning to In-Phase Kids care.
Vomiting
Diarrhea
Undiagnosed Rash
Red, “goopy” eyes – not watery, but thick yellow drainage
Any contagious illness diagnosed by a physician. A return to school letter will be required.
Parents will be called to pick up child if:
Temperature of 100.4 or greater
Vomiting
Diarrhea
Undiagnosed Rash
Persistent complaint of pain
Epinephrine Auto-injector
We do not have any unassigned epinephrine auto-injectors at this site.
Procedures For Medical Emergencies
Director or Designee will assess the severity of the injury or illness and begin first aid.
After assessment either:
911 will be called by director or designee
Parents are notified of injury and directed as to the status of the situation. If the child is being transported:
The director, designee or nurse on call will accompany the child to the hospital.
Parents will speak with person who will transport the child and approve this decision and be given the address of the hospital.
If the child is not being transported, but needs to be seen by a medical professional, the nurse on call will talk directly with the parents and direct them to pick up the child immediately. It is the parent’s responsibility to seek medical care if it is not deemed necessary to transport the child to a medical facility immediately.
If the child is being transported or was seen by a medical professional, the director, designee, or nurse on call will complete an accident form and fax it to the local licensing office within 24 hrs of the time of accident.
The director, designee, or nurse on call will contact the parent within 24 hrs to assess the condition of the child if he/she was transported.
Emergency Preparedness Program
A Crisis Emergency Plan will be prepared for each In-Phase Kids location
The site director will train the staff on the contents of the Plan.
There will be a record of practice drills done on the campus with the children and staff.
